JUDGEMENT
There is before this Court a report from ADR Secretariat on successful mediation and resolution of this dispute.
The document has been duly executed by the parties.
I therefore, enter judgment in favour of parties, in accordance with the terms they have accepted as contained in the Terms of Settlement document filed on 19-11-2019: 1. That the parties have agreed that an INVESTOR or a DEVELOPER should be contracted to develop the bare land behind the shop constructed by Roland Annan and Peter Annan which belongs to all of them namely: Charlotte Annan, Henry Annan, Roland Annan, Charles Annan and Peter Annan.
2. That whatever construction is made on the land shall be shared equally among the five (5) siblings after expiration of the contract between the five(5) siblings and the developer.
3. That any advance payment made by the Developer shall equally be shared among the above named siblings.
4. That when the construction commences the shops contracted by Roland Annan shall also be shared among the siblings excluding Peter Annan, who has also constructed some shops in the front of the Land.
5. That new construction shall be constructed within 3 years time frame.
That parties pray that these Terms of Settlement be adopted as Consent Judgment of the honorable Court.
6. There is no order as to cost. 7. The suit is struck-out as settled.
