RULING
[1] This action commenced when the Plaintiff/Respondent (hereinafter
referred to as the “Plaintiff”) filed a suit at the High Court in Accra on 18th February 2021, against the 1st Defendant/Appellant (hereinafter referred to as the “1st Defendant”). The Plaintiff sought the following reliefs:
“a. A declaration that the dismissal of the Plaintiff by the letter dated 10th December, 2020 was wrongful and/or unlawful and same constitutes a
gross breach of contract.
b. A declaration that the request contained in the letter of dismissal to personally refund certain monies the plaintiff received and/or payments made by the Defendant between January 2010 and June 2020 of her
employment is wrongful, unfair and/or unlawful.
c. An order compelling the Defendant to release the provident fund
contributions withheld together with interest from the time it became
due, within seven (7) days after judgment.
d. General damages/compensation for wrongful and/or unlawful dismissal.
e. Costs
f. Any other/further order(s) as this Honourable Court may deem fit.”
[2] The Plaintiff, a Ghanaian, was employed by the Defendant as an Accountant for seventeen years until 10th December 2020. The Defendant is a registered Trust engaged in development projects and supporting
education and science.
[3] The Plaintiff stated that in 2009, the government dissolved the Defendant’s board, and the organization operated without a board until June 2020. On 24th December 2019, the retiring Acting Executive Director,
who had served in an acting capacity for five years, handed over
administration of the Trust’s fund to the Plaintiff, who acted as Executive Director until a substantive Executive Director was appointed. She performed these duties alongside her role as Accountant, managing the Trust competently and in accordance with applicable law.
[4] During her nearly eighteen years of employment, the Plaintiff claims she had never been queried for misconduct. In June 2020, she was informed of the Ministry of Energy’s appointment of a new Acting Executive Director and cooperated during the transition. However, the Plaintiff asserts that the new Acting Executive Director immediately sought to create a hostile work environment, including secretly investigating her while she was on leave.
