WEDEG COMPANY LIMIITED v. WILBENCO INTERNATIONAL DEVELOPMENT

Parties have filed Terms of Settlement and are praying the Court to adopt same as

Consent Judgment.

1. By a Writ of Summons and Statement of Claim filed on 17th day of November,

2022, the Plaintiff sued the Defendant for the following reliefs:

1. A declaration that Defendant has breached the contract entered into between

the parties dated 22nd February, 2022.

2. An order directed at the Defendant to pay all monies owed to the Plaintiff for

the building materials supplied.

3. Interest on the amount from 10th March, 2022 till date of final payment.

4. General damages for breach of contract as executed between

5. Plaintiff and Defendant.

6. Cost including lawyer's fees.

Parties through their respective Counsel sought leave of the Court to settle their

issues amicably which the Court granted.

They subsequently filed these terms of settlement and are praying the Court to adopt

same as Consent Judgment.

These are the terms of settlement filed by Parties:

TERMS OF SETTLEMENT

WHEREFORE the Plaintiff and Defendant have agreed to terms of settlement as

follows:

i. The Defendant shall pay the Plaintiff the sum of GH¢4,200,000.00 as full and

final settlement of the sum owed to the Plaintiff for the building materials

supplied to the Defendant.

ii. The Plaintiff has agreed to accept Ten (10) months installment

payments from the Defendant for sum owed.

iii. That the Defendant shall pay in ten equal monthly installments of

GH¢420,000.00 commencing on or before the 31st December 2022.

iv. These terms of settlement embody the entire understanding of the parties

in respect of the matters contained or referred to in it and there are no

promises, terms, conditions, or obligations, oral or written, express or implied

other than those contained in these terms of settlement.

v. That the above terms of settlement shall be subject to the usual default

clauses and should the Defendant default the entire sum owed together with

interest shall become payable.

vi. That the terms of settlement as contained herein be adopted by the

Court as Consent Judgment.

The Court hereby adopts the Terms of Settlement filed on the 5th of January, 2022

which has been duly executed as Consent Judgment of this Court.

The Court strikes out this suit as settled.
