JUDGMENT
By a Writ and Statement of claim filed in the Registry of this Court on the 28th of October, 2020, the Plaintiffs claim against the Defendants jointly and severally the following reliefs:
1. Damages for personal injuries sustained and for pecuniary losses and damages suffered as a result of the negligence of the 2nd Defendant acting as a servant and/or agent of the 1st Defendant in a motor accident at the Accra-Tema Motorway near Kings Cottage Police Post in the Greater Accra Region on or about the 10th day of October 2016.
2. Special damages including Medical and Funeral expenses of twelve thousand, nine hundred and sixty one Ghana Cedis (12,961.00).
3. Interest on any sums found to be due to Plaintiffs at the prevailing bank commercial rate from the 11th day of October, 2016 to the date of final payment.
4. Any further or other reliefs.

Case of the Plaintiffs
The Plaintiffs are the father and mother respectively of Prince Enoch Okrah who was injured and Bridget Mawumenyo an infant who died as a result of a motor accident which occurred on the Accra-Tema Motorway near Kings Cottage Police Post on or about 10th day of October 2016.
The 1st Plaintiff brings this action in his capacity as the Next Friend of his injured Son Prince Enoch Okrah and Personal Representative of his late Daughter Bridgette Mawumenyo Okrah.
The 2nd Plaintiff also sustained injuries in the said motor accident which occurred on the Accra-Tema Motorway on or about the 10th October 2016.
The1st Defendant is the owner of the vehicle, Mercedes Benz Sprinter Bus with registration number GN 5145-14 which was involved in an accident on the Accra-Tema Motorway on or about October 2016.
The 2nd Defendant acting as Servant and Agent of the 1st Defendant was the driver of the said Mercedes Benz Sprinter Bus which was involved in the vehicle accident on Accra-Tema Motorway on or about October 2016.
On or about 10th day of October 2016, the 2nd Plaintiff with her infant children namely Prince Enoch Okrah and Bridgette Mawumenyo Okrah now deceased, were travelling from Accra towards Tema as fare paying passengers on board a twenty-two seater Mercedes Benz Sprinter Bus with registration number GN 5154-14 then being driven by the 2nd Defendant as a Servant/Agent of the 1st Defendant.
On the Accra-Tema Motorway, near Kings Cottage Police Post, the Defendant’s vehicle whilst in the inner lane, spun into the outer lane crashed into the gutter on the nearside.
