VINCENT AYIVOR VS HEAD OF LOCAL GOVERNMENT SERVICE & ANOR.

01. The writ of summons taken from the Registry of this Court has the underlisted endorsements: a) A declaration that after working as Deputy Director in the Local Government Service continuously for 17 years, he is entitled as of right to be promoted as per the conditions of service b) An order that Plaintiff should be accordingly promoted to the next grade which is Director of Administration.

02. The facts as in the pleadings are that Plaintiff had joined the Ghana Civil Service in 1989, having graduated from the University of Ghana in 1979 and had worked for ten [10] years, previously.

In addition, he stated he had started on the grade of Assistant Director.

Class 2B and rose through the ranks to Assistant Director Class 1, and on 1/01/2001, was promoted to Deputy Director.

In conclusion, Plaintiff alleged, he had attended several interviews at the Public Services Commission but was never promoted, even though he had written petitions for the matter to be looked into.

03. The Statement of Defence showed that, paragraph 2 of the statement of claim and non-contentious part of it were admitted.

The Defendant denied the averments that, it refused to promote the Plaintiff.

The fact that Plaintiff had submitted a performance appraisal Report to the Public Service on 21/01/2010, was stated and it was added that there is no Regulation in the Public Service that guarantees, automatic progression.

It was stated Plaintiff had failed various promotion interviews, hence he could not progress to the next rank/grade.

a) The triable issues accepted are: i. Whether or not Plaintiff is entitled to be promoted to the deserving levels ahead ii.

Any other issue(b) In the Additional Issue/s is one issue, namely: i. Whether or not Plaintiff passed any of the promotional interviews conducted by the public services commission 05. EVIDENCE: Plaintiff’s testimony as found in his Witness statement, is virtually like what he has stated in his statement of claim.

In cross-examination of him he stated, he had worked from 1989 to 2020 and had filled appraisal form for promotion purposes, but was not promoted until he retired.

He disagreed that he could not be promoted whilst on retirement.

These few questions which were asked of him: Q: Did you attend an interview with the Public Services Commission in 2010 for promotion to the Grade of Director.

A: Yes.

Q: You will agree with me that, you did not pass that interview, am I correct? A: Yes.
