JUDGMENT
INTRODUCTION
1. On 19th April, 2022 the accused was arraigned before this court for the below offences:
COUNT 1
STATEMENT OF OFFENCE
Inducing Tenant to Quit: contrary to section 27(1) of the Rent Act, 1963 (Act 220).
PARTICULARS OF OFFENCE
Alhassan Faizatu, Landlady, Aged 37years: in the month of March 2022 at Gbolo
Kpalsi, Tamale in the Northern Magisterial District and within the jurisdiction of
this court, being a landlady of a house at Gbolo Kpalsi, with intent to compel the
lessee of such premises to give up possession thereof, did remove the personal
effects valued GHS5,040.00 of a tenant by name, Seidu Abdul Wahab.
COUNT 2
STATEMENT OF OFFENCE
Causing Unlawful Damage: contrary to section 172(1) of the Criminal Offences
Act, 1960 (Act 29).
PARTICULARS OF OFFENCE
Alhassan Faizatu, Landlady, Aged 37years: in the month of March 2022 at Gbolo
Kpalsi, Tamale in the Northern Magisterial District and within the jurisdiction of
this court, being a landlady of a house at Gbolo Kpalsi, you intentionally and
unlawfully caused damage to belongings valued GHS5,040.00 the property of one
Seidu Abdul Wahab.
COUNT 3
STATEMENT OF OFFENCE
Stealing: contrary to section 124(1) of the Criminal Offences Act, 1960 (Act 29).
PARTICULARS OF OFFENCE
Alhassan Faizatu, Landlady, Aged 37years: in the month of March 2022 at Gbolo
Kpalsi, Tamale in the Northern Magisterial District and within the jurisdiction of
this court, being a landlady of a house at Gbolo Kpalsi, you stole belongings
valued GHS5,040.00 the property of one Seidu Abdul Wahab.
FACTS OF THE CASE
2. The facts as given by the prosecution are that complainant, Seidu Abdul Wahab, was
a tenant at accused person’s house. On 13th January, 2022 complainant had a rented
new apartment and moved in, but left his belongings were still at accused person’s
house. Accused sent text messages to complainant to pack out his belongings, but
complainant was out of town. Later complainant went to the house on several
occasions to pick his items, but accused had changed the padlock to his room. On 17th
March, 2022 complainant went to the house again to pick his belongs but saw that
accused had packed his belongings out of the room. His items included: a double bed
and mattress GHS2,050.00, sound system GHS750.00, two black luggage GHS750.00,
two window blinds GHS450.00, wall and standing dressing mirrors GHS500.00, LED
ceiling lights GHS65.00, four window curtains and curtain rod GHS
