His Lordship Emmanuel Amo Yartey (J) ruled on an interlocutory application by the 5th Defendant acting as Applicant in an ongoing civil matter involving the 6th Defendant/Respondent. The Applicant sought leave to file a defence to the 6th Defendants counterclaim, permission to file a supplementary witness statement for the 5th Defendant, and authority to file new witness statements because the original witnesses are deceased. After considering submissions from counsel for both sides, the Court determined that granting the application would enable it to effectively and effectually resolve the issues between the parties. The Court accordingly granted the application, authorized counsel for the 6th Defendant to cross-examine the 5th Defendant on matters raised in his submission, and directed that the Applicant file the relevant processes within seven days.
