REPOT ON SETTLEMENT
Counsel for Plaintiff Your Ladyship, we humbly pray this Honourable Court that the Terms of Settlement filed bythe parties be hereby adopted by this Honourable Court as the Consent Judgment of theCourt.
CONSENT JUDGMENT
By a Writ of Summons and Statement of Claim issued at the High Court Adentan on the 9th day of September, 2022 the Plaintiff claimed against Defendants the following reliefs: WHEREAS: A declaration of title to all that piece or parcel of land as described in the schedule below: ALL THAY PIECE OF LAND situate, lying and being at ASHALEY BOTWE in the Greater Accra of the Republic of Ghana containing an approximate Area of Q. 19 Acres or 0. 08 Hectares and bounded on the North by Lessors Land measuring 77. 9 feet more or less on the South by Proposed Road measuring 79. 9 feet more or less on West by Lessors Land measuring 101. 8 feet more or less on the East by Lessors Land measuring 101. 8 feet is more or less.
b. Recovery of Possession of all that parcel of land by the Plaintiff.
c. Damages for trespass.
d. Cost of this suit.
e. An order of perpetual injunction against the Defendant, his assigns, privies, Workmen, servants, hirers, agents and all those claiming through the Defendant from interfering with the land as described in the schedule.
f. Any other relief (s) as this Honourable Court shall deem fit and proper in the circumstance (s).
2. The Defendant admits that the Plaintiff's grantor has a judgment over the land in dispute;
3. The Defendant admits that the Plaintiff by virtue of his grantor's judgment is the owner of the land in dispute;
4. The Defendant holds the Plaintiff blameless and safe of any demolishing of structures on the land in dispute; NOW THIS SETTLEMENT AGREEMENT WITNESSES AS FOLLOWS:
a. The Plaintiff shall pay the Defendant One Hundred and Twenty Thousand Ghana Cedis (GHS120, 000. 00) as full settlement of whatever interest the Defendant or any third party claiming through him might have had in the land in dispute.
b. The Defendant shall within Forty-Eight (48) hours order his caretaker to vacate the land in dispute and make available the land to Plaintiff for developments.
c. That the Defendant warrants that he has the capacity to settle the matter and absolves the Plaintiff of any future action either by himself, his assigns, privies, Workmen, servants, hirers, agents, any next-of-kin or third party claiming through the him.
5. The court shall adopt the terms herein contained
