“My understanding is that a Will is a very special and solemn legal document
in which a person declares his wishes as to how his property should be
distributed, disposed of or managed after his death, and the greatest respect
due to a deceased person is in my opinion, to give effect to his ‘Last Will and
Testament’ unless there are compelling reasons militating against doing so”.
After the grant of probate of the last Will and Testament of Late John Wisdom
Humphrey Fummey had been granted by the High Court Accra to the

In the High Court, Accra, Justice William Boampong adjudicated a dispute over the probate of the estate of the late John Wisdom Humphrey Fummey. The widow and surviving children challenged a probate obtained by Mrs. Virginia Aklade (née Fummey), a co‑executor, who secured probate as sole executor despite directions to join the other executors or have them renounce. Registry records confirmed probate was granted on 25 September 2008, while a purported probate dated 4 September 2008 was found fraudulent. The court determined that the codicil had been deposited and read, and that Aklade knew of it but failed to disclose or properly challenge it. Proper challenge required proceeding under Order 66 Rules 26(2) or 28(1) of C.I. 47. The grant was revoked, accounts ordered, and a perpetual injunction issued. The defendant’s counter‑claim to exclude the codicil was refused, and costs of GH¢50,000 were awarded against her.
