AI Generated Summary
The Court of Appeal (Ghana), per Dzamefe JA, reviewed an appeal arising from a land dispute between Nii Odi Kwao Asumang & Others and William Sowa Charway & Others (Suit No. BL 563/2008). After pleadings and directions, the High Court’s Land Division fixed hearing for 3–4 November 2011 but struck out the appellants’ case on 3 November for want of prosecution when appellants and counsel did not appear, awarding GH¢1,000 costs. The appellants promptly moved to relist; although respondents did not oppose, the High Court refused under Order 36. On appeal, applying standards from Bremer, Department of Transport v Chris Smaller, and Ghanaian guidance in Nana Kwesi Afodo, the Court of Appeal found no intentional or inordinate delay, noted counsel’s late appearance and serious issues to be tried, and held the discretion was exercised unfairly. The appeal was allowed; the orders were set aside and the case remitted to another High Court for trial on the merits, with concern also expressed about the unaddressed counterclaim.
