RULING
This is an Application by the Plaintiffs/Applicants praying the Court for an order of Interlocutory Injunction restraining the Defendants/Respondents, their agents, assigns, workmen, privies, or anyone claiming through the Defendants from alienating Plaintiff’s land or any part thereof, having any dealings in respect of the land in dispute or any part of the land in dispute and to desist from any form of development in any way or form or interference with the land pending the final determination of the suit.
The Application was resisted by the 2nd to 4th Defendants/Respondents.
Both parties exhibited title documents depicting their legal interest in the subject matter for which same requires the Court’s protection.
Obviously the Court is obliged to determine the truth in both assertions during the trial.
However, before doing so I hold that there is the need to protect the status quo ante pending the final determination of the case.
I shall however restrain all the parties, their agents, assigns etc. from having anything to do with the subject matter pending the final determination of the suit.
No order as to cost.
