The wife Petitioner seeks the dissolution of the marriage celebrated between herself and the Respondent on the grounds of unreasonable behaviour.
She therefore prays for the following reliefs:
i. For the dissolution of the marriage.
ii. An order that the matrimonial home which is a four bedroom house located at Amrahia in the Greater Accra Region of the Republic of Ghana which is in the joint names of the parties be shared equally between the Parties.
iii. An order that a similar house also constructed during the subsistence of the Marriage in Akrofo Xeviefe which is the Respondent’s hometown be shared equally between the parties.
iv. An order that the four acres farm land acquired in the joint names of the parties at Ayikuma in the Dangme West district off the Dodowa Road in the Greater Accra region be shared equally between the parties.
v. Hyundai Santafe purchased with registration number GC 5444-11 during the subsistence of the marriage be sold and the proceeds shared equally between the parties.
vi. Alimony of fifty thousand Ghana cedis (GH¢50, 000)
vii. That the Respondent be mulcted in costs of the proceedings.
Any further/other relief(s) that the Honourable Court may deem fit.
According to the Petitioner’s testimony on oath, after getting married customarily in January 2006, they lived together in rented premises before moving into their jointly acquired building.
She says that the Respondent started maltreating her and threatened to divorce her at the least provocation, and that following a confrontation upon his return from a trip, he physically assaulted her and subsequently stopped talking to her and giving her housekeeping money.
Consequently, she says she moved out of their bedroom and later the Respondent locked her out of the house and told her he was no longer interested in the marriage.
It is her case that he attempted to dissolve the marriage by sending drinks to her father and when he threatened her further she lodged complaints at the Domestic Violence and Victim Support Unit (DOVVSU). She denies being violent, unreasonable and a flirt.
She called two witnesses namely Joseph Koney Mensah and Jonathan Adzidu and subpoenaed the Executive Director Samuel Bonney of the Public Service Housing Loan Scheme in support of her case.
There are no children of this marriage.
