RULING
This is an Application by Plaintiff/Applicant praying the Court for an Order staying the Execution of the Judgment of the Court dated 28th day of February, 2023.
The Affidavit in Support of the Application reads:
“I, KWAME KYERETWIE OFORI of No. 1 Rufus Green Parks, Katamanso Odebaaye in the Adenta Municipality of the Greater-Accra Region of the Republic of Ghana make oath and say as follows:
1. That I am the Plaintiff/Judgment Debtor/Appellant/Applicant herein.
2. That the facts to which are deposed are within my peculiar knowledge except otherwise stated.
3. That at the hearing of this Application, I shall crave the indulgence of the Court for my Counsel to refer to all processes already filed on the Court’s docket as if same have been set out herein in extenso and repeated verbatim.
4. That on 28th day of February 2023, this Honourable Court gave Judgment against me. (See photocopy of the certified true copy of the said Judgment annexed hereto and marked as Exhibit “KK01”).
5. That dissatisfied and/or aggrieved by the said Judgment I caused my Lawyers to file an appeal against the said decision (See photocopy of the Notice of Appeal annexed hereto and marked Exhibit “KK02).
6. I am advised by Counsel and verily believe the same to be true that to succeed in such an Application, the Appellant/Applicant must at this stage without seeking to argue the appeal, show that the appeal is bona fide brought to test the rightness of the Judgment and demonstrate that there are serious legal issues to be determined on appeal.
7. That I have set down serious grounds of Appeal some of which include the issue whether technically after the demise of the original 3rd Defendant Abraham Mensah Ashong, he was ever properly substituted since the substituted person, Frederick Okley Ashong confessed during cross-examination that he is not an Administrator but came to Court because he is the biological son of the deceased. (See the discourse from the certified proceedings supplied Counsel before written addresses)”:

Q. I believe you are also aware that this suit was personally against your father the 3rd Defendant.
A: That is so?
Q: So in what capacity were you substituted in the place and stead of your late father for you to testify in this matter before this Court?
A: As the eldest son of my late father, after the death of my father I stood in to represent all the children.
