RULING
On the 29th day of December, 2022 the Plaintiff/Applicant filed the instant Application praying the Court for an order of Interlocutory Injunction restraining the Defendants/Respondents, their assigns and privies, agents, servants, workmen, grantees and successors in interest, other alienees and relations whatsoever and howsoever described from interfering with Plaintiff’s development, or dealing with or having anything to do with the land in dispute until the final determination of the suit.
Attached to the Application is an Affidavit in Support and annexures.
The Application was resisted by the Respondents who filed their Affidavit in Opposition and Statement of Case.
I have examined the submission put up by Counsel for the parties.
It is my considered view that there are legal issues to be resolved by the Court for which reason there is the need to preserve the status quo ante.
In circumstance I hold that aside the operation of his block and haulage factories by the 5th Defendant I hereby restrain all the parties, their agents, assigns etc. from carrying out further developments on the land pending the final determination of the suit.
