JUDGMENT
The plaintiff herein, Francis Ebo Abrahams, until 31-07-2009, was an employee of the defendant, Hotel Investments (Gh.) Ltd., which operates the Labadi Beach Hotel in Accra.
The plaintiff’s employment took effect from 01-10-2000. On 31-07-2009, the defendant dismissed the plaintiff by letter which has been tendered in this court as Exhibit K. The relevant part of the said letter states as follows:
“Please be advised that you are hereby dismissed from your employment at the Labadi Beach Hotel for gross misconduct.
On 17th July 2009, you were called by the hotel’s security personnel three times to attend to an urgent situation regarding the discharge of water you had ordered for the hotel. You ignored their calls and instead conducted a private telephone conversation on your mobile phone contrary to hotel procedure. When confronted, you lied that you were cleaning a chandelier on the hotel terrace which turn out to be untrue.
Our further investigations into the matter indicate that you have been involved in irregularities relating to the delivery of water to the hotel including the following:
a) recording inaccurately the amount of water delivered.
b) and falsifying particulars of persons doing the delivery.
All these lend credence to the claim of the tanker driver, Kofi Asante, on 17th July 2009 that you were part of a conspiracy to defraud the hotel by having him bring an empty water tanker to the hotel premises and pretend to deliver a full tanker of water.
Your behavior amounts to gross misconduct of Article 48(b) (v) (ix) and (xv) of the hotel’s collective bargaining agreement governing your employment at the hotel.”
Upon receipt of the dismissal letter, the plaintiff caused his solicitor to write to the defendant on 24-09-2009 to reconsider its decision but the latter, by its solicitor’s letter of 09-10-2009, rejected the plaintiff’s request (See Exhibits N and P, respectively).
The plaintiff, on 23-10-2009, therefore, caused a writ to issue from this court by which he claims the following reliefs:
“a. Declaration that his dismissal is wrongful.
b. Damages for wrongful dismissal.
c. Payment of his entitlements to his due salaries from July 2009 to date of judgment or payment of same with interest at the current bank rate.
d. Monetary payment for his earned leave withheld after approval together with inter
