This Ghana Court of Appeal case concerns competing claims to 456.25 acres at Adjiringano-North, Accra. The plaintiff company derived its interest from Baron Ernesto Taricone, who had obtained extensive leases from the Nii Ashong Mlitse Family of Teshie and assigned interests to the plaintiff in 1979. Defendants asserted the land is Nungua Stool land; the 1st defendant registered multiple parcels and the 4th co-defendant claimed 39.59 acres. The trial court held the land belongs to the Nungua Stool, dismissed the plaintiff’s claims, and apportioned possession to parties based on development. On appeal, the Court held that while the plaintiff’s leasehold exists by operation of law, it is limited to 50 years due to constitutional and statutory restrictions on non-citizens and corporate persons. The Court rejected referral to the Supreme Court, affirmed the trial judge’s application of burden-of-proof principles, nullified the possession order for procedural noncompliance, confirmed the impact of government acquisition, and ultimately dismissed the appeal.
