RULING
This is an Application by the 2nd Defendant/Applicant praying the Court for an order setting aside the Plaintiff’s and 3rd Defendant’s Witness Statement per the reason that the Power of Attorney they relied on are defective.
According to the Applicant Exhibit A, the Power of Attorney relied on by the Plaintiff was signed by the Principal and his witness but was never commissioned.
It is also his contention that the Power of Attorney relied on by the 3rd Defendant was also not commissioned.
I have critically examined the submission put up by the Applicant and Counsel for the Respondents.
The Supreme Court in Fiorini Luca and Fiorini Alessandro v Mr. Samir & 2 Ors, Dennislaw [2021] DLSC 10155, held that a Power of Attorney not commissioned by a Commissioner of Oath is still valid for which reason I accordingly dismiss the Application.
Cost of GH¢3000 each in favour of Plaintiff and 3rd Defendant.
