MS. MUSEY: My Lady, we are pleased to announce to the court that we have been able to file the Terms of Settlement. We pray the court to adopt it as a Consent Judgment. Humbly submitted.
BY COURT: Even though there is no copy on the court docket yet, I have been given a copy of the Terms of Settlement so filed dated 13th June, 2023. Per the Terms of Settlement the Plaintiff and 1st Defendant have agreed on the following terms:
i. The 1st Defendant paid the Plaintiff an amount of US$10,000.00 on 5th May, 2023;
ii. The 1st Defendant paid the Plaintiff an additional amount of US$20,000.00 on 15th May, 2023; and
iii. The 1st Defendant shall pay the Plaintiff a sum of US$35,945.61 on or before 31st July, 2023.
The 1st Defendant shall pay the Plaintiff’s Lawyers their Professional Legal Fees in the sum of GH¢92,820.40 in 3 equal instalments as follows:
a. A sum of GH¢30,940.14 on or before 30th June, 2023;
b. A further sum of GH¢30,940.14 on or before 31st July, 2023; and
c. A final sum of GH¢30,940.00 on or before August 2023.
In the event of any default by the 1st Defendant, Plaintiff shall be at liberty to reinstate the original debt plus interest less all payments made and proceed into execution without leave of the court.
The court hereby adopts the Terms of Settlement filed by the parties and duly signed by the Solicitors of the parties as Consent Judgment of the court. The default clause applies.
