The Plaintiff instituted the instant action on 8th June, 2012, against the Defendants for the following reliefs: i. A declaration that the shooting into the Plaintiff’s vehicle and injuring her without just cause was a negligent act.
An order directing the Defendants to pay damages for negligently causing harm to the Plaintiff and for the pain and suffering occasioned thereby.
An order directing the Defendants to pay the Plaintiff the expenses and losses referred to in paragraphs 19 and 20 of the Statement of Claim.
An order directing the Defendants to bear the cost of specialized medical care recommended by the Medical Doctor. . v. An order directing the Defendants to bear the cost of repair of Plaintiff’s vehicle which was damaged by the Defendants by their negligent act.
Any other order/s as the Honourable Court may deem fit.
A summation of the Plaintiff grievance is as follows: The Plaintiff states she is a 49 years old mother of three children and a cateress resident in Accra.
According to the Plaintiff, on the evening of 28th June, 2011, she and her son (Raymond Kpakpo Addo) driving on their way home, stopped briefly around Mamprobi Girls’School, Kumani, a suburb of Accra, to see a friend.
The Plaintiff further states that whilst talking to her friend, she was shot by a stray bullet from a police or military patrol team.
That being in pain and shock, her son and her friend helped her into a nearby container shop.
The Plaintiff avers that the police or military patrol team was informed of the gunshot but they failed or refused to take her to the hospital for treatment.
According to the Plaintiff, she later collapsed and was admitted for 18 days at the Korle-Bu Teaching Hospital, Accra.
That while on admission, the Regional Police Commander sent a police team to visit her a few times to convey the sympathies of the Ghana Police Service.
The Plaintiff further states that three days after she was discharged, a police delegation was sent to her house by the Greater Accra Regional Commander, DCOP Rose Bio Atinga, and she offered the sum of Six Hundred Ghana Cedis (GH¢600. 00) to take care of herself.
That the delegation promised to come back to compensate her but it did not fulfil their promise.
