RULING
On the 24th day of November 2022, the Applicant, Nene Tetteh Wayo Duamor XI filed the instant Application praying the Court for an order joining him to the suit as 4th Defendant in L276/94 and 7th Defendant in Suit No. SOL/2/12.
The Affidavit in Support of the Application reads:
“I Nene Tetteh Wayo Duamor XI of House No. D/W/076 Dawa Ningo New make oath and says as follows, that;
1. I am the Deponent and Applicant herein.
2. I am the Chief of Dawa and the Head and Lawful Representative of the Aniamorse Clan of Dawa, and I bring this Application on my own behalf and on behalf of the Aniamorsi Clan seeking to protect the interest of the Clan.
3. My attention has been drawn to the consolidated suits in which the Plaintiffs are claiming to be owners of Dawa lands.
4. At the hearing of this Application my Counsel shall seek leave of the Honourable Court to refer to the processes filed in the suit so far as if same were reproduced in this affidavit in extensor and sworn to on oath.
5. The Loweh Aniamorsi Clan is owner of land situate at Ningo and which land includes all that piece and parcel of land situate and lying at Dawa which is bounded on the North by Osudoku Clan lands and bounded on the East by Kabiewe lands and on the South by Osabunya lands and the West by Djamaku lands consisting an area of 14,494.326 acres more or less. 6. The Loweh Aniamorsi Clan has over several centuries exercised overt act of ownership over the land in dispute and which ownership has been recognized by judicial and quasi-judicial decisions as well as Governmental Agencies.
7. Following the death of Nene Agborkey Duamor X as the Chief of Dawa and the Head and Lawful Representative of the Aniamorsi Clan of Dawa, I was nominated, elected and enstooled as the substantive Chief of Dawa on 1st August, 2013, a position I have held till date. (Attached and marked as Exhibit NTD 2 copy of my name in the Extract from the National Register of Chiefs).
8. Just like my predecessors, upon being made the Chief of Dawa, I also became Head and Lawful Representative of the Aniamorsi Clan of Dawa as is customary with the people of the Aniamorsi Clan of Dawa.
9. As Chief of Dawa and the Head and Lawful Representative of the Aniamorsi Clan, I am the custodian of all Dawa lands and the proper person to alienate, sue and be sued in respect of Dawa lands, a fact well known to the Aniamorsi Clan, the larger
