This is an Application by the Defendants/Applicants praying the Court for an order striking out the Reply filed by the Plaintiff/Respondent.
The Application was resisted by the Plaintiff/Respondent.
A critical examination of the submission put up by Counsel for the Applicant calls for a perusal of the reply complained of.
A look at the reply depicts the Plaintiff pleaded among others fraud.
Clearly the Applicant cannot respond to same.
I shall therefore grant the Application for the Plaintiff to put his house in order to enable the Defendants respond to same since per the Reply complained of they cannot do so.
Application is accordingly granted.
The Plaintiff has fourteen (14) days within which to put his house in order.
