JUDGMENT
According to the Affidavit of Interest filed by Claimants, the vehicles seized by the Deputy Sheriff on 19th August 2022 in execution of a judgment debt obtained by the Execution Creditor against the Defendant Judgment Debtors belong the Claimants.
These are:
1. Hyundai Santafe Station Wagon with registration number GY 2140-21 which belongs to Brenyah Ama Serwaah; the 1st Claimant herein.
2. Mercedes Benz G 63 AMG with Registration Number EN 7770-21 which belongs to Asante Group of Companies, the 2nd Claimant herein.
3. Range Rover, Overfinch with trial plate No. DP 4277 C 2021 which belongs to Eunice Kai Okang Adjetey; the 3rd Claimant herein.
That these vehicles do not belong to the Defendant Judgment Debtors and so have been wrongfully attached in execution by the Deputy Sheriff.
That for this reason, the Court ought to order the immediate release of the vehicles that have been wrongfully attached in execution to Claimants.
According to the Affidavit in Response filed pursuant to the Affidavit of Interest, all the vehicles attached in execution of the judgment debt belong to the Judgment Debtors.
That the said vehicles were registered in the names of the three Claimants to deceive the public as to who the real owners are.
That the Judgment Debtors are the beneficial owners of the said vehicles because the Claimants operate as alter egos to the said Judgment Debtors.
That 2nd Defendant Judgment Debtor is the beneficial owner of the Mercedes Benz G 63 AMG with registration number EN 7770-21.
That this is because he paid for the said Mercedes Benz as per Exhibit SY 5, his cheque stub which showed that he paid Ninety Thousand, Two Hundred and Twenty Ghana Cedis (GH¢90,220.00) on 25th June 2021 to Silver Star Limited.
That the Driver and Vehicle Licensing Authority (DVLA) Road Worthy Certificate and a Third-Party Insurance in respect of the Land Rover with registration number GJ 6432-21 were in the name of Dominic Netiful; and not Dominic Ntiri as had been indicated in Exhibit SY 3 as the owner of the said vehicle.
That a search conducted at the Driver and Vehicle Licensing Authority (DVLA) by the Execution Creditor as to who the owner of the said vehicle with the said registration number indicated that the said registration number was fake as per Exhibit SY 8.
According to the depositions in the said affidavit, curiously enough, the same law firm that represents the 2nd Defendant Judgment Debtor also acts for all three Claimants.
