1. Application of 52 & 53 Vict. c. 45. to Scotland. U.K.
Subject to the following provisions, the M1 Factors Act, 1889, shall apply to Scotland:—
(1) The expression “ lien ” shall mean and include right of retention; the expression “ vendor’s lien ” shall mean and include any right of retention competent to the original owner or vendor; and the expression “ set off ” shall mean and include compensation.
(2) In the application of section five of the recited Act, a sale, pledge, or other disposition of goods shall not be valid unless made for valuable consideration. Marginal Citations M1 1889 c. 45 .
