GH - TEGBO ANITA FLAURE vs ASIM ABAZA

The Petitioner filed the instant Petition on 13th July, 2018 and prayed for the following reliefs:

a) A dissolution of the Ordinance Marriage between the parties.

b) That Respondent be ordered to make to the Petitioner such maintenance pending suit and thereafter such periodical payment as may be just

c) That in the alternative the Respondent be ordered to pay to the Petitioner a lump sum of Fifty Thousand Ghana Cedis (GH50,000.00)

d) Costs

Parties were married on the 8th day of May 2010 at the Metropolitan Assembly under the Provisions of Part Three of the Marriages Act, 1884-1985 (Cap 127) in the Greater Accra Region of the Republic of Ghana.

Parties cohabited at Onjankle Street Abelemkpe, Accra after the said marriage. Petitioner is a Teacher and Respondent an Electrical Engineer working with his own company. The Petitioner is an Ivorian and the Respondent a Serbian but both parties are domiciled in Ghana.

Trial was held on 24th November 2022. Parties filed their terms of settlement on 30th March, 2022 and agreed on the following terms;

TERMS OF SETTLEMENT

That the marriage celebrated between the parties be dissolved.
That the Respondent shall pay to the Petitioner an amount of GH45,000.00 (Forty-Five Thousand Ghana Cedis) as Financial Provision in the following manner:

i) GH15,000.00 shall be paid within 28 days of the adoption of the terms

ii) GH30,000.00 shall be paid within 8 months from the date of the first instalment payment.

There shall be no order as to costs.
That the terms shall be adopted by the court as the judgment of the court and a full and final settlement of all claims and liabilities arising out of the dispute between the parties herein.

BY COURT

The Terms of settlement filed by parties on 30th March 2022 is hereby adopted as the judgment of this court. It is hereby decreed that the Marriage celebrated between the parties on 8th day of May 2010 between the parties herein be and is hereby dissolved as having broken down beyond reconciliation.
