OFORI v. ARTHUR

In a tenancy dispute governed by Ghana’s Rent Act, 1963 (Act 220) and the Rent Regulations, 1964 (L.I. 369), Kingsley-Nyinah J addressed the statutory concepts of “nuisance” and “annoyance.” Noting that neither the Act nor the Regulations provides definitions for these critical terms, the court rejected an abstract, rigid approach to interpretation. Instead, it endorsed a beneficial construction that turns on the peculiar facts and circumstances presented in each case, in order to realize the protective and remedial purposes of rent control. The judge also urged legislative action to supply reasonable, practicable definitions to guide future adjudication and enhance consistency while maintaining sensitivity to factual variations across landlord-tenant disputes.
