II. That there be no order as to cost
III. That the Parties herein have agreed that the above Terms of Settlement shall be the final and effectual settlement of all claims in this suit and either party is discharged from any other obligation towards the other party and shall be adopted as Consent Judgment between them.
Each party is to bear his own cost.
