After careful consideration of the petition that was never answered and evaluation and the petitioner’s evidence on record, I am of the view that the marriage between the parties has broken down beyond reconciliation as all attempt to reconcile them has been unsuccessful. See Section 2 of Matrimonial Causes Act, Act 367 The marriage is hereby dissolved.

The marriage certificate with license No. AMA 1201/94 is hereby cancelled. Each party is free to re-marry.

The terms of settlement filed by the parties on 6th June, 2022 is adopted as part of the final judgment of the Court. The terms are as follows:

i. That the marriage celebrated between the Petitioner and Respondent under the Marriage Ordinance dated 25th June, 1994 be dissolved by the Honourable Court.

ii. That the court grants the Petitioner custody of Kwodwo Ofori Agyepong and Yaw Asiedu Agyepong who are the minor children of the marriage.

iii. That the court makes an order for both the Petitioner and the Respondent to jointly fund the school fees, education and health needs of the children of the marriage.

iv. That the court makes an order that both the Petitioner and the Respondent jointly cater for the upkeep of the children of the marriage.

v. That the Petitioner waives her interest in the storey building built by the couple during the pendency of the marriage, on H/No. 6, Kwashe – Bu, Accra the matrimonial home.

vi. That the Petitioner shall keep for herself absolutely all the properties she acquired during the pendency of the marriage.

vii. That each party shall settle his or her own costs.

Each party is to bear his or her cost.
