EMMANUEL KWASI ADUSEI vs RUTH AFFRAM

Petitioner, a Chartered Accountant, and Respondent, a Business Woman, married under the Ordinance at Word of Life Christian Centre, Manet, Spintex, on 24 February 2013, and later cohabited in Achimota. Their union produced four children: Ruth Sakyiwah, David Nana Kwaku, Gracelyn Ohemah Yaa, and Emmanuel Prince Kofi Adusei. Petitioner alleged irretrievable breakdown due to Respondent’s unreasonable behaviour, including departures from the matrimonial home; Respondent agreed dissolution was warranted and emphasized that Petitioner should care for the children. The Court framed the sole issue as breakdown beyond reconciliation under Act 367, and, citing Danquah, Mensah, Marian Partey, and the Evidence Act’s preponderance standard reinforced by GIHOC, examined the evidence. Admissions in cross-examination and a detailed Terms of Settlement confirmed the breakdown. The Court adopted the Terms as consent judgment, dissolved the marriage, granted custody to Petitioner with reasonable access for Respondent, ordered continued accommodation for Respondent until the children reach majority, and awarded Respondent GHC50,000.
