I have considered the petition and the answer, as well as the cross-petition. I have evaluated the evidence on record and I am of the view that the marriage between the parties has broken down beyond reconciliation and same is hereby dissolved as all attempts by family and friends to reconcile their differences has been unsuccessful. See Section 2 of the Matrimonial Causes Act 1971, Act 367.
The marriage certificate with License No. SL1210366 is hereby cancelled.
The terms of settlement filed by the parties on 29th November, 2022 is adopted as part of the judgment of this court and parties are bound by it. The terms are as follows:
a. The marriage between the parties contracted on the 9th day of April, 2016 in accordance with the Marriage Ordinance (Cap 127) at the Tesano Royal Hotel, Tesano, Accra be dissolved.
b. Custody of the sole issue of the marriage be granted to the Respondent with reasonable access given to the Petitioner. That is to say, when school is in session, the Petitioner or his representative shall pick up the issue every other weekend and when school is on vacation, Petitioner shall have access to the issue for the first half of the holidays.
c. The Petitioner’s access to the issue shall be reviewed accordingly should the issue suffer regression in speech, education or show signs of molestation given that, the Petitioner may not be able to fully take care of the issue due to work schedules and therefore will engage others to take care of the issue.
d. The Petitioner shall be responsible for the provision of the necessaries of life of the issue which shall include but not limited to educational, medical, feeding, clothing, etc.
e. The Petitioner shall support Respondent with a monthly maintenance of One Thousand Ghana Cedis (GH¢1,000.00) subject to an annual upward review taking due cognizance of inflation.
f. That the Petitioner shall be actively involved in all decisions touching and concerning matters relating to which school the issue shall attend at any point in time until the issue attains the age of majority or shall be able to make such decisions on his own.
g. The Parties shall at all times conduct themselves in decorum and with mutual respect so that the issue shall grow in an environment of love and understanding.
h. It is agreed that each party shall bear his/her own costs and there shall be no order as to costs in these proceedings.
