“I do not subscribe to the view expressed by Apaloo JA. in Eku @ Condua III v Acquaah (1968) C.C. 116, that the inherent judicial function of the traditional council to hear disputes between natives has not been taken away by the Act. I think such an interpretation defeats the vary purpose of the Act, which in my view aims at circumscribing the judicial functions of the traditional council within a certain compass. I think it can hardly be said that cases relating to succession have anything to do with ‘causes or matters affecting chieftaincy.’”
